Family Law

Divorce/Separation
To file for divorce or annulment in Virginia, an individual must be a resident and domiciliary of Virginia for at least six months prior to filing for divorce. There are two categories of divorce in Virginia: fault and no-fault. A fault divorce may involve adultery, sodomy or buggery committed outside marriage, mental and/or physical cruelty, desertion, and conviction of a felony resulting in confinement in excess of one year. A no-fault divorce may occur if the parties have lived separate and apart for a period of one year. If the parties have no children and have executed a separation agreement, they may obtain a no-fault divorce after six months of separation. In fault and no-fault divorces, the parties may address division of property acquired during marriage, support (child and spousal), and child custody/visitation.

Separation and Prenuptial Agreements
Our firm prepares for spouses who intend on living separate and apart indefinitely or who intend to file for divorce, separation agreements regarding division of marital assets, child custody/visitation, support (child and spousal), and other matters relating to marriage. Furthermore, we prepare prenuptial agreements for those intending to marry who wish to establish how property will be divided or if spousal support will be awarded in the event of a divorce.

Custody/Visitation
We can help clients establish orders for custody, visitation, and support (child and spousal) through the Circuit Court and Juvenile and Domestic Relations District Court. If a material change in circumstance occurs after entry of your court order, we can assist in modifying the terms of your order.

Adoptions
Our firm has experience with various types of adoptions: step-parent adoptions (e.g., a remarriage in which the step-parent desires to adopt the step-child), parental placement adoptions in which parents directly place their child with another for adoption, foster care placement adoptions in which children have been placed in foster care due to abuse and neglect by their parents and the parents have not complied with all requirements to have their children returned, adult adoptions in which an individual at least eighteen years old is adopted by another, and adoptions of children from another country.

Name Changes
We assist with obtaining name changes for both adults and minors. The petition for name change is filed in the Circuit Court of the locality in which the party petitioning for a name change resides.
